A product kept out of the register of Russian software by servers abroad
The request
The company planned to enter its own educational platform in the register of Russian software and assumed that a Russian legal entity was enough. Its servers, however, were located abroad, and the client did not know what the localisation requirement consists of.
What we did
We broke the localisation criterion down into two components: at least half of the source code and updates created in Russia, and technological independence – the product operated and managed from the territory of Russia, servers included. We showed what confirms the Russian origin of the code on filing: certificates of transfer and acceptance of exclusive rights signed with Russian developers. We handed over a summary of the requirements software must meet to be included in the Unified Register.
The result
A refusal on localisation grounds was ruled out before the application was filed, not after it. The company received a specific list of what needs to change – moving the servers to Russia and securing the rights to the code with transfer and acceptance certificates – and confirmed that both conditions can be met.
